The rule of hearsay. Naming a false witness before a legal case has gone to court

 Hearsay is  the basis of the informer (or 'false witness') phenomenon. It is summed up by the trained and untrained person as 'hear-a-lie,tell-a-lie' when such an imagined person is referring to that well-known appearance or apparition,the lickspittle or police witness.

The proposition that litigants are routinely spied upon is not a wrong headed illusion. However ,the pleading party will learn to distinguish fact from fiction only in court whereas his lawyer will be well aware of a spy or what lawyers call an obstruction to justice at an early stage. Pledged to uphold the honour of the court and protect the functioning of the judicial system he will not divulge his cognisance of the police informer to anyone not even his secretary or partner. It is in court,therefore,that only hard evidence can be heard after depositions have been laid.

What desperados such as Sinn Fein politicians,the armed constabulary and Unionist politicians such as Eric Gault alike cannot see is that 'signs and wonders',gossip and rumour,have no bearing on court proceedings. Insinuations are for the birds and bees and ignored in the search for hard evidence.

The problem of our age, poisoning by the NHS

Any properly-trained advocate will tell you that doctors are a pushover in court because they rarely appear to answer allegations of professional misconduct. Doctors are often involved in plots to pervert the course of justice. They are notorious amongst barristers and solicitors as dangerous liars and frauds who cover up for one another. Doctors believe firmly that the human mind and body can overcome any obstacle. That is something against which incontrovertible proof exists. 

Most doctors give vague, "scientific" answers in court but barristers ask searching questions and judges require fast proofs and cast-iron guarantees against future medical misconduct. (Judges and advocates initiate the suspension of out-of-touch medical personnel in a law-governed society but no part of Ireland falls under that description).

Naming a medical impostor? 

Usually a very dangerous move if your case has not come before the court or you have not pleaded a case. That action opens the injured party up to arbitrary injustice and police retribution.

Why? 

Challenging liars.

Where your case has been argued and you are awaiting judgement,name false witnesses freely. You will meet them regularly as they seek to mitigate their liability in criminal law for misleading the police by walking on your right hand side after Isaiah. That sort of wayward individual will also attempt to mitigate liability in civil law for his associates obtaining financial benefit or control of someone else's assets by fraud or deception ('holding out',Texas 'hold-up'). If the main culprits hiding behind legality are too old or infirm and find you abnoxious, they will send someone in their stead usually one of their family members to meet you in the street.Give them no hint of intention as to your required amount for settlement of the cash or they will use it against you and try to put you over a barrel using other family members and criminals such as the police and ambulance drivers and medics and other untrained polecats. Money is all such greedy exploiters and upper class people crave.

When these plotters set out on their "Journey"( Tony Blair),they knew that they were incurring "serious" (Berniece Swift) risks personally and financially, particularly as regards their peace of mind and illegal actions.

You shall meet the Righteous Judge the following Sunday.

"After braving the 'slings and arrows of outrageous fortune' in a troubled jurisdiction such as Northern Ireland prior to meeting the arbiter of a long-standing dispute with the legal and judicial authorities and the police-this shall likewise occur on a Sunday-you shall meet the accuser who is both 'Good Thief and Bad Thief' combined, someone destined to lose his life to medical mischance."

Don't try to change horses in mid-stream by finding a new advocate during lengthy proceedings,keep your cards close to your chest and speak when spoken to.

If it is a particularly cack-handed lawyer who you have to represent you and a particularly outrageous witness is called or you have to answer a trumped up charge or series of allegations from women,you may,in Germany, say,"Satt!" or,in Italy,"Basta!" and,to a criminal allegation in the latter jurisdiction,simply,"Sacramento!" Say to a het-up female psychiatrist or murderous psychopath,"I don't want you to open your mouth. I want to talk to the organgrinder not the monkey or a performing gnome such as you."

Kant's romantic idealism or Marx's scholarly materialism?

No one should take Kant seriously when social problems-those presented by war and famine and the lack of civility and social altruism as we see everywhere and at all stages in history-are under discussion.

 Noone, it appears,apart from a wordy buffoon (Dean,Dozent) at Heidelberg University or a daft, Indian rote-learner from Tubingen University. The academic world is full of these ready-rub psychophants and fools. 

Intelligent Westerners do not want to read penny prose emanating from backwoods German ideologues nor have it retold by other ideologues. No,no more than they want to listen to broadcasts about business ethics, private philanthropy and literary balderdash coming from London, Berlin, Paris and New York in the 1990's. 

Why economic obsolescence of the European Marxist dictatorships, the political revisionism and what is the link to financial asset-stripping in the East, 1990-2005?

Trade,the changes in the world economy and greed are the key to the self-generating,self-immolation of any mass of capital be it in private or public  hands. His advocacy of national unity in Germany and national liberation movements in Ireland,Italy, Hungary and Poland,the latter a country facing East and West colours much of his early writing.

Probably it was a presentiment of things to come.

Some of Marx's propositions come with a vaguely sentimental tinge. His press articles on parliamentary by-elections in the 1850's  inspire political meddlers to copycat behaviour. I refer to buying someone's vote with a pint of beer as do the Tories in every country.

In his prose,he positted Russian absolutism as the cause of the defeat of Napoleon's 'liberty with stability'. He opposed what he called the Holy Alliance of Austria-Hungary, Prussia,England and Russia.

Comparisons and the origins of concepts. Some insights into the concept of capitalism 

It is sometimes assumed that the 'head' of a team of horses on a carriage was the real  point of departure for Capital as a lead economic  concept. Marx's written epithet "Accumulate,accumulate,accumulate. That is Moses and the prophets!" is a nineteenth century analogy of a horse accelerating quickly when hitched to a carriage and whipped.

A modern philistine,a political meetings man called the literary conclusion of his imperialist  rampage "A Journey". I refer to Tony Blair. 

A literary coincidence perhaps. In his capital horse setting off on a journey at the head of a team of horses, Marx's allusion to capitalism rests. 

A lead horse and,to introduce the Hebraic tradition,a horse is viewed in Isaiah as a fearless creature which rushes blindly forward.

To turn the analogy around we refer to Greek wisdom to discern the fate of the modern lead horse,the working class. The European workhorse in Aesop's fables can be construed as the donkey whose diet was steadily reduced to a blade of  grass a day by its merciless exploiter. 

Both of these allusions when construed with the etymology of Capital derive from a contemporary and a pre-Marxist mode of thinking.

Later we learn of two propositions of Russian Narodnik (populist) "revolutionary spontaneity" and "excitative terror" from Lenin in his early years of socialist activity from 1896-1903. 

The contemporary relevance 

Those may well be two propositions the immature Tony Blair read of in his early years as a Member of Parliament and served him as a guide to understanding our Irish Narodniks. In 1983,he,for his part, certainly believed in what followed,that which the socialist successors to Narodism practiced, state control of society,Terror and publicly owned industry.

The division in modern social sciences lies between endogenous (or ideological) reasoning and socialism whether the socialism in question be critical or materialistic.

In our political environment,this spaltum or schism takes the form of conservative against labour and the left or ideology against reason.

Ideology of the extreme leftwing tendency ignores all restrictions and legal restraints on political authority. Marxist ideology sets aside law and the basic tenets of a civilised society.

Romantic idealism is in the ascendant in a world without materialist state models. The Chinese and the mixed economies of the East are too weak to oppose fascist revanchism and the currents of war emanating from Europe and the Americas.

The State we're in

The countenance of Rome or the NHS and Arab poison cup for Northern Ireland?

Neither!

What is needed in our troubled society is proper mediation with distraught female NHS doctors, Indian psychiatrists and nursing males. These wimmin have a skewed view of normal consciousness and the demands of what most people call  'life'.  The female harpoon artists in psychiatric hospitals are unqualified to talk of social conditions or 'real' people,those who labour with hand and mind. Note the devastation left by sick and twisted female doctors in Fermanagh and Tyrone and parts further afield.

Let us focus on the feminist or not-a-man-about-the-place type of harpoon artiste....

A woman's  little peccadillo to know a little but talk a lot accounts for a lot of the deaths brought about by NHS medical interventions. The multiple instances of culpable homicide have gained media and political support. Witness the vagaries of the social consciousness and the pitched voices in our health-saturated media and wider society.

Let me be clear. Our society is over-endowed with public medicine. It has an over-indulged educational system for medicine and nursing which forms psychological responses to the human and political issues thrown up by modern society.

An alternative?

Let a co-operative arrangement prevail in our hospitals and in nursing education. Let an understanding not to engage in bogus science form the young and immature mind.

In the transition to a measure of self-determination, all that can be hoped for is a break with the police-medical nexus. A medical nightmare is still hanging over a society plunged into darkness by the Kitson civil society pacification model.

For the novice,it is much better to say as little as possible to state functionaries in the NHS unless you need urgent medical assistance or a relative  requires rehabilitative care. In those instances, contact a reliable and trustworthy family doctor at the earliest opportunity.

Consult any doctor?

No,never put your fate in the hands of a tempestuous female doctor or an auxiliary nurse.Women who are employed in the NHS and their public apologists don't know what they are talking about. The 'gamey chicks' can't keep their tongue in their mouth for more than ten seconds.

These lectures are the source of some peoples ruin.We think of absent family members. In some instances, idle-minded doctors have been rung and they in turn have solicited police back-up or confided in  third parties.

 No proper nurse or doctor who is concerned about others ever talks about her work to third parties, not even to members of her own family.

The lack of recognised public standards or police probity is embedded in our society  from Belleek to Ballyclare.

We think of the activities of detectives sent by Southern politicians and Gardai in the upper ranks of the Central Detective Unit. These focus on throwing radicals out of their modest accommodation in Dublin. I remember well Pat Harte and Dave Taylor.

 Evictions by police are a commonplace in the South but you won't hear that on the RTE radio news,least of all from chatterboxes such as Mary Harney, Bairbre de Bruin or Mary Lou Mc Donald. 

The media personae of Southern journalists

Those who are goaded into calling the chat-lines on radio programmes are encouraged to talk a lot of old rubbish by cynical presenters. Old  bollockses such as Joe Duffy and Katie Hannon are put up to their nuisance tactics by political conmen,street crawlers and dolemen.

Broadcasting organisations and their select audiences,we think especially of broadcasters employed by the national government,the BBC,RTE or PBS?

The chattering classes!

How do these intermediaries find such a ready,if rapidly diminishing,audience amongst modern populations? 

Perhaps it is a case of "Aithnionn ciarog ciarog eile" and,"One chatterbox recognises another chatterbox".

An outside perspective 

Is, as the English say, stupidity endemic to the Irish race?

Perhaps,so. 

Read literature now circulating about proper staffing levels in hospitals, proper manning of G.P. surgeries and bringing in more foreign doctors when we already have far too many doctors, psychiatric nurses and CMHT social workers doing no meaningful work but going about the work of political disruption.

And,to boot,

....many hospital orderlies are engaged in interference with the workings of the courts and tribunals. Some are delving into matters which are no business of the medical profession.

Not such a pretty sight,really!

Money and Power or Industry and Trade

 Marx believed in the ultimate victory of industry over finance (Grundrisse,Capital Vols.1-3). He drew a distinction between industry and finance.

The dichotomy between industry and finance is a false dichotomy even by his own account. Read Das Kapital. Industrial capital and finance form a unity known as riches or wealth. Surely his supposed dichotomy is a nonsense with the benefit of hindsight. In this regard of finance being overcome by industry,we think of Hitlerism and Hjelmar Schacht and Fink of the Reichsbank,their approach (Paul Bang,Europaische Revue, Marz 1943).

Let someone who was Irish working  class answer both propositions,"There'll be money when we're gone.." (Dermot Mc Carroll after my mother,Mary Patricia).

Consciousness comes from species-being (Feuerbach) and social conditions. If you prefer,creation, background, society and conditions and upbringing,not a living deity alone. For deists,God leaves a lot to chance and doesn't always like to pump  from below decks on a ship taking in or  take the helm of a ship heading for the rocks. 

Everybody has a different experience of the Deity but in my experience,while interventionist when genuinely and needfully implored,he is largely laissez-faire.

Northern Ireland

 I think, perhaps,that I have not been calling a spade a spade over this last twenty-eight years..

In my view,the North of Ireland is an example of a state governed and administered by AUTHORITARIAN ways and  means,a police state in other words. The irrefutable truth of the matter is that many of the worst offenders in the police and army left years ago and many more are preparing to depart.

There are clear signs in my instance since September 2020 that the police realise their covert tactics have not worked. A mindless thug such as Chief Inspector Pat Brogan must always get his way until defeat in his casual slander,pubtalk or calumny and that can only come about by invoking  the protection of the courts. He cannot tolerate the fact that his critic has survived medical defamation, police entrapment and random acts of thuggery. He has to admit defeat.

The times when passions are at fever-pitch are at the New Year and Twelfth of July. That is well-known. What is less well-known is those areas where there is very little friction or where old hatreds are in decline and community politics hold sway. We think in particular of non-divisive leaders in North Belfast,Fermanagh,West Belfast and Derry City.

Try as we might there is no possibility of avoiding constitutional rancour and opposition to the outdated armed policing. As Elizabeth of England says herself she would have preferred some arrangements "somewhat differently".

The worst kind of Blueshirt is a member of Fianna Fail in a leading position in government not excepting that particularly useless sort of bitch,a Sinn Feiner who can't keep her knickers on. The hi-jack party, Sinn Fein,seems to have dumped most of the informers firstly into the lap of Republican Sinn Fein in the South and,in North Belfast lately,persuaded them to make common cause with the wretched Alliance Party.

The South needed Fianna Fail to lead national renewal at every stage and make the hard choices between labour and capital that had to be made. The did so without the lickspittles of Fine Gael.

The republicans were involved in bringing the South out of its centuries-old slumber in the arms of Mother Church but radicals and democrats were cooperative too.

The consequence of the revival of the industrial movement was the tax marches of the 1970's. Those marches removed the initiative from big farmers and placed the ball firmly at the feet of urban businessman and town dweller.

The future is a lot brighter than the past but even the new rich risk suffering from the withdrawal of US investment and the coming global retrenchment.

The loss of large swathes of labour-intensive, low surplus value manufacturing has already hit Limerick. If we cannot keep agri-food manufacturing such as infant milk supplement,we risk losing the cohesion of town and country.

Changing terms of trade and cheap untrained labour threaten to unseat the indigenous Irish blue collar worker from his traditional high stool.

Fianna Fail are just as aware of the dangers posed by not just American imperialism but British neo-colonialism and the tramps in their pay, collectively.

They are not prepared to undermine our social wellbeing by spending ever greater amounts on a burgeoning arms bill for ships and planes.

To do so would put the bottom foot on an upward-bound escalator of wasteful spending and reduce the country to pauper-y where Continental Europe finds itself in large measure.

Europe has been preparing for twenty years on a war that has never come and the weapons of death are being disgorged into the Ukraine for a healthy profit.

On consideration,it is better not to become involved in a one-way arms race with our neighbours and to put our trust in the United Nations while distancing ourselves from aggressors with their coterie of paid assassins and bagmen. In the latter instance,I refer to the United States and the UK.
